Entries for the 2019 Fine Homebuilding - Benjamin Moore/Pro Paint Contest (the “Contest”) sponsored by Fine Homebuilding® and Benjamin Moore & Co. (the “Sponsors”) will be accepted during the period beginning at 12:01 a.m. ET on April 25, 2019 and ending at 11:59 p.m. ET on August 7, 2019 (the “Contest Period”). All entries must be received during the Contest Period to be valid. The Contest is open to legal residents of the United States (including the District of Columbia and Puerto Rico) and Canada (except Quebec) who are at least eighteen (18) years of age, or the age of majority in their jurisdiction of residence, whichever is older, at the time of entry (the “Entrants”). The Contest is void anywhere else outside the United States, Canada and where prohibited by law.
Employees, officers, and contractors (including immediate family members and members of the same household) of the Sponsors, and their respective affiliated companies, subsidiaries, distributors, dealers, retailers, vendors, and all other entities associated with this Contest, are not eligible. Only one (1) prize may be awarded to persons of the same family or living in the same household.

Submit a photo (or photos) and a brief description of your best paint project or a paint job that you are the most proud of. Indicate which one of the three (3) categories listed below that you feel your entry best fits.
- Master Painter
- Best Transformation
- Best Historic Preservation
By entering this Contest, you agree that the name, company name, and photograph(s) of the Entrant may be featured in Fine Homebuilding’s print and digital media channels.
You may also nominate others for entry into this Contest by providing the information of the person you are nominating on the entry form. Indicate that you are entering a photo(s) and description of another person’s work for consideration in this Contest.
LIMIT: Each Entrant may enter in more than one category; up to three entries total per person will be accepted. The entries can be for your own work, or on behalf of a contractor/painter you wish to nominate. Entries received in excess of the stated limit will be voided.
PHOTO SUBMISSIONS: Photo(s) must be submitted along with your entry. The photo(s) submitted must be images of work that you or a nominated paint contractor have performed and must not infringe upon or violate the rights of any third-party. If you did not take the submitted photo(s) yourself, you must obtain written permission from the photographer to submit such photo(s) for this Contest. By entering this Contest, you (or the photographer, if applicable) grant the Sponsors the right to publish such photo(s) in their print and digital channels if your entry is chosen as a winner. Photos and any descriptions provided within shall not contain any content that infringes any person’s intellectual property rights, rights of privacy or publicity, is obscene, defamatory or otherwise in violation of any applicable law, or is disparaging of Sponsors. Any entry that violates these provisions shall be disqualified. Entrants grant Sponsors a worldwide non-exclusive royalty-free and fully transferable right and license to display, reproduce, distribute, publish, perform, display and modify the submitted photos and descriptions, in any and all media and formats, whether now known or hereafter developed, including without limitation, online and for any commercial or other purpose. Entrants further agree to indemnify Sponsors and their affiliated entities, and each of their officers, directors, employees and agents, from and against any claims, losses, lawsuits, liabilities and expenses (including attorney’s fees and costs of suit) arising out of any photo, comment or other material provided by Entrant in this Contest.
WINNING: All eligible entries will be judged by the Editors of Fine Homebulding® Magazine, together with representatives of Benjamin Moore. Winners will be chosen based on the quality of the paint job submitted and the thoroughness of the description of how the submitted job fits the category being entered (Master Painter, Best Transformation, or Best Historic Preservation).
Three (3) winners will be chosen -- one (1) winner in each category. Any one person may only win in one category.
PRIZES / VALUES: Each of the three winners will receive a prize of free Benjamin Moore paint or painting supplies redeemable at a Benjamin Moore retail store (in the levels described below), AND will be showcased on Fine Homebuilding’s print and digital channels (Fine Homebuilding® Magazine and FineHomebuilding.com), to celebrate their work and craftsmanship.
Arrangements for such showcasing will be made at the sole discretion of the Sponsors and the winner’s participation in the same is a condition to the award of the prizes.

- Best Transformation Award = $1,500 worth of Benjamin Moore Paint or Supplies
- Best Historic Preservation Award = $1,500 worth of Benjamin Moore Paint or Supplies
TERMS AND CONDITIONS: The Sponsors are not responsible for unavailable network, failed server or other connections, miscommunications, interrupted, misrouted or scrambled transmissions or other errors or problems of any kind whether mechanical, human, electronic or otherwise. The Sponsors assume no responsibility for lost, stolen, delayed, damaged or misdirected entries or for any failure of the website during the Contest Period for any problems or technical malfunction of any telephone network or lines, computer on-line systems, access providers, computer equipment, software, failure of any e-mail entry to be received by the Sponsors due to technical problems or traffic congestion on the Internet or at any website, of any combination thereof including any injury or damage to an Entrant’s or any other person’s computer related to or resulting from playing or downloading any material related to the Contest. The Sponsors reserve the right, in their sole discretion, to cancel or suspend this Contest should a virus, bug or other cause beyond the reasonable control of the Sponsors corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way. Entrants must abide by these Contest Official Rules and Regulations (the “Official Rules”) to be eligible to win. By entering this Contest, you acknowledge that you have read and agree to comply with these Official Rules. The personal information collected through this Contest is subject to the Privacy Policy located at http://www.taunton.com/thetauntonpress/privacy.asp.
NO PRIZE TRANSFER OR SUBSTITUTION: No prize or any portion thereof is transferable or redeemable for cash. Any portion of the prize that is not used is forfeited. There will be no substitutions for the prizes, except by the Sponsors, in which case a prize of equal or greater value will be substituted. Sponsors disclaim any and all warranties regarding the prizes, including without limitation, the warranties of merchantability or fitness for a particular use.
TAXES: Except where prohibited, payment of any federal, state, local or other tax liabilities, including but not limited to luxury, sales, use, and income tax that may be applicable, is the sole responsibility of the winners.
WINNER NOTIFICATION: On or about August 1, 2019, three (3) winners will be chosen, one in each category, from among all eligible entries received. The winners will be notified by email initially, and then by mail within ten (10) days of the selection. Odds of winning will depend upon the total number of eligible entries received.
CLAIMING PRIZE: The winners must sign and return an “Affidavit of Eligibility and Liability/Publicity Release” within ten (10) days of notification, or their prize may be forfeited. Winner will also be required to provide proof of age. (Tennessee residents and any other state where prohibited, will not be required to sign a Publicity Release as a condition of winning a prize.)
JURISDICTION: As a condition of participating in this Contest, Entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with this Contest, or the prize awarded, shall be resolved individually, without resort to any form of class action, through the appropriate jurisdictional state or federal court in the State of Connecticut. Under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim punitive, incidental or consequential damages including attorney's fees or any other damages, other than for Entrant's actual out- of-pocket expenses (i.e., costs associated with participating in this Contest), and Entrant further waives all rights to have damages multiplied or increased.
RELEASES: By participating in this Contest, Entrants agree to release the Sponsors and any other organizations affiliated with the sponsorship, fulfillment, administration, prize support or suppliers, and advertisement or promotion of the Contest and each of their respective officers, directors, agents, representatives, employees, successors, assigns, parents, affiliates, subsidiaries, and advertising agencies (collectively, the "Released Parties") from any and all actions, claims, injury, loss, death or damage arising in any manner, in whole or in part, directly or indirectly, from participation in this Contest and/or acceptance, use or misuse of the prize.
